About the General List

The General List is a part of the administrative division of VCAT. It reviews a wide range of administrative decisions upon their merits in an informal and expeditious manner, e.g. disputes about:
  • freedom of information
  • transport accidents
  • crimes compensation
  • fire brigade charges,
  • electrical licences/registration, etc.

Jurisdiction

The jurisdiction of the list embraces a wide variety of matters. The principal area of jurisdiction relates to the review of decisions of the Transport Accident Commission. Other areas of frequent resort relate to freedom of information, State superannuation and criminal injuries compensation.

VCAT has jurisdiction under section 69 of the Electricity Safety Act 1998 to review decisions made by the Office of the Chief Electrical Inspector (OCEI) for Energy Safe Victoria. Previously, the Electrical Appeals Board heard appeals against certain decisions made by the Office of the Chief Electrical Inspector for Energy Safe Victoria. Following the transfer of its functions to VCAT, people who are aggrieved by such a decision may now apply to VCAT for review of the decision. Applications for review will be processed in the VCAT's General List and may be transferred to the Occupational & Business Regulation List (OBR) if the tribunal deems fit.

Powers of the tribunal

On hearing an application for review, the tribunal stands in the shoes of the original decision-maker and has power to affirm, vary or set aside the decision under review and to substitute its own decision therefor. It may also remit the matter to the original decision-maker for re-determination.

Constitution of the tribunal

Members of the General List consist of lawyers including judges. They are appointed by the Governor-in-Council. A tribunal can be made up of one or more members depending on the nature of the application.
