From 1 July 2018, objectors have 28 days to lodge a VCAT application for review of a planning decision.
The Victorian Parliament recently passed planning regulations that increase the number days from 21 to 28.
When a municipal council or other responsible authority makes a planning decision, it issues a 'notice of decision'. Counting of the 28 days starts on the day after the date on the notice of decision.
VCAT will apply the 28-day limit to applications it receives on or after 1 July 2018, under section 82 of the Planning and Environment Act 1998.
