Access to documents for renting cases

Who can access documents

You can access documents in a residential tenancies case if you are:

  • a party A person or organisation directly involved in a VCAT case, including a person or organisation that has brought the case before VCAT or who is defending claims made against them. in the proceeding ( applicant The person or organisation applying to VCAT. or respondent The party against whom orders or relief is sought by an applicant. )
  • representing a party at the hearing The time and place at which VCAT hears the parties argue their case and makes a decision. – for example, you are the tenant’s representative or the landlord’s estate agent
  • advising or assisting a party who has given you permission to access documents on their behalf.

You do not have to pay for access to the documents in these cases.

Access by email or file inspection

We can email you a copy of:

  • any orders made
  • the original application, if it was made using the Residential Tenancies Hub.

All other applications and documents are paper-based. We can arrange for you to access the file at VCAT to photocopy the documents you need. If you cannot come in, it may take up to five business days to get the documents. Let us know if the hearing is within the next 48 hours – we will do our best to make urgent arrangements.

You may find it faster to contact the applicant or their representative (for example, their real estate agent) to get a copy of the application. The applicant is legally required to provide a copy of the application to the other parties in the case.

Email renting@vcat.vic.gov.au using the template below or call us on 03 9628 9800.

If you call us, we still require your request by email as the record of permission to access documents.

You do not need to send us a separate consent signed by your client.

If you are from a support agency:

Subject: Document request – [party name/VCAT reference number]

My name is [your name] from [agency] and I am assisting or representing [party name] in [VCAT reference number]. I have permission to access documents on their behalf.

The hearing is scheduled for [time and date].

I would like to access these documents: [ list A List is an area in VCAT that deals with cases of a similar nature. For example, the Residential Tenancies List decides cases between tenants and landlords, and the Civil Claims List handles disputes about buying or selling goods and services. the documents that you want]
